Passenger sues driver after Mustang leaves roadway, flips

A man has filed suit against the driver in whose car he was riding when it left the road and overturned several times.

Bradley Brown claims he was riding in a 2003 Ford Mustang Shelby K. Diepenbrock was driving south on Illinois Route 255 near the Fosterburg exit when she lost control of the vehicle, causing it to leave the highway and to flip multiple times.

Because of the accident, Brown suffered injuries to both of his knees requiring surgery; sustained injuries to his head, neck, arms and back; suffered great pain and mental anguish; became disabled; lost his normal life; and incurred medical costs, according to the complaint filed Feb. 22 in Madison County Circuit Court.

Diepenbrock negligently failed to keep the vehicle under proper control, failed to stop the vehicle in time to avoid a collision and drove too fast, the suit states.

Brown is seeking a judgment of more than $50,000, plus costs.

He will be represented by Michael P. Glisson of Williamson, Webster, Falb and Glisson in Alton.
