Two people have filed suit against the driver who they say caused a collision when she entered their lane.
Karla and Ronald Emig claim Ronald Emig was driving north on Illinois Route 4/Route 15 near its intersection with Terveer Road in Fayetteville Township on Jan. 31, 2009, when defendant Kendra Weinhoffer, who was driving south on the same road, crossed into their lane and collided with them. At the time of the accident, Karla Emig was riding as a passenger in the vehicle.
According to the complaint filed Feb. 16 in St. Clair County Circuit Court, Karla Emig sustained severe and permanently disabling injuries to her head, neck, back, knees, legs and body while Ronald Emig sustained pain, anguish and injuries to his head, elbows, legs and body.
Both lost wages because of their inability to work and incurred medical costs, the suit states.
Weinhoffer negligently failed to yield the right-of-way, failed to keep a proper lookout, failed to keep her vehicle under control and drove too fast, the complaint says.
In their two-count suit, the Emigs are seeking a judgment of more than $100,000, plus costs.
Bruce R. Cook of Cook, Ysursa, Bartholomew, Brauer and Shevlin in Belleville will be representing them.
St. Clair County Circuit Court case number: 10-L-72.
