Contaminated instruments used during prostate biopsy, suit claims

A man claims he sustained injuries after a doctor used contaminated instruments to perform a prostate biopsy.

Delvin Sylvester filed a lawsuit Feb. 11 in Madison County Circuit Court against Saint Anthony's Health Center and Dr. Shoo I. Cho.

Sylvester claims he went to Saint Anthony's Hospital in Alton on Feb. 12, 2008, to have a prostate biopsy performed by Cho.

However, during the biopsy, Cho failed to use equipment that remained free of contamination, according to the complaint.

As a result, Sylvester sustained severe and permanent injuries, lost a chance of early recovery, incurred medical costs and suffered severe physical pain and mental anguish, the suit states. In addition, he sustained loss of a normal life and lost income, the complaint says.

In his five-count complaint, Sylvester seeks an unspecified judgment and costs.

Tad Armstrong of Armstrong Law Offices in Edwardsville will be representing him.

Madison County Circuit Court case number: 10-L-158.
