American Express sues over unpaid balance

American Express has filed suit against a Collinsville man and a construction company who it says defaulted on payments of more than $50,000 he charged to their credit card.

American Express Bank claims Roosevelt Garrett and The Star Construction Company charged various items on their American Express account.

In return, American Express sent monthly statements to Garrett for the account, but he failed or refused to make the payments requested, according to the complaint filed Jan. 19 in Madison County Circuit Court.

"Defendant is currently indebted to Plaintiff for unpaid charges in the total amount of $57,407.76," the suit states.

In addition to the money is says it is due, American Express is seeking attorneys' fees of $350, plus additional damages, court costs and pre-judgment interest.

It will be represented by Michael L. Starzee of Blitt and Gaines in Wheeling.

Madison County Circuit Court case number: 10-L-47.
