Injuries claimed in O'Fallon rear-end pile up

A woman claims she suffered severe injuries after being involved in a multi-car collision.

Deborah D. Winn filed a lawsuit Jan. 14 in St. Clair County Circuit Court against Mark O. McCallister and Julie A. Robison.

Winn claims she rode in a vehicle traveling west on Central Park Drive in O'Fallon on Jan. 19, 2008, when the driver stopped behind another vehicle in traffic waiting to make a turn onto Green Mount Road.

According to the complaint, Robison also drove on Central Park Drive and had to make an abrupt stop behind the vehicle in which Winn rode. In turn, McCallister failed to apply his brakes in time and hit Robison, who then struck the vehicle in which Winn rode, the suit states.

In addition to her injuries, Winn experienced pain and suffering, lost her enjoyment of life and incurred medical costs, the complaint says.

Winn blames McCallister for causing the accident, saying he drove too fast for traffic conditions, failed to reduce his speed to avoid a collision, failed to keep a proper lookout, failed to maintain control of his vehicle and failed to exercise due care. In addition, he negligently failed to keep a safe distance between him and the vehicle in front of him, according to the complaint.

Robison negligently drove too fast, failed to keep a proper lookout and failed to keep a safe distance between her and the car in front of her, the suit states.

In her two-count complaint, Winn seeks compensatory damages of more than $100,000, plus interest, attorneys' fees, costs and other relief the court deems just.

Thomas J. O'Toole Jr., Joseph M. Wientge Jr. and N. Scott Kimble of Mickes, Goldman and O'Toole in St. Louis will be representing her.
