A Bethalto man's slip and fall in his apartment complex's allegedly icy parking lot went to trial Monday in Madison County.
The trial began Monday at 9 a.m. with jury selection. The jury was seated Monday afternoon.
While the defense argued it had done what was needed to keep the lot clear of hazardous conditions, plaintiff's attorney J. Robert Edmonds questioned the property manager about why an incident report was filled out weeks after his client's fall.
Madison County Associate Judge Thomas Chapman is presiding, although the case is assigned to Madison County Circuit Judge Dennis Ruth. Ruth is presiding over another trial that also opened Monday.
Plaintiff Lloyd Taylor is suing the management company of his Bethalto apartment complex.
Taylor alleges that James Green Management Inc., RMS and Residential Marketing Systems Inc. failed to clear ice and snow from his apartment's parking lot in February 2004.
Taylor claims that because of the snowy condition of the lot, he slipped and fell, injuring his right arm and shoulder.
He is seeking $50,000 and costs in damages.
The defendants had previously tried to have the suit dismissed without success.
The defendants are represented by John McMullin.
The case will resume Tuesday.
The case is Madison case number 06-L-107.
