Injuries claimed in Route 111 accident

A man has filed suit against the driver who he says rear-ended him.

Jeffrey D. Sharp claims he was driving north on Route 111 at its intersection with Bruene Avenue in Pontoon Beach on Sept. 2, 2008, at about 5:11 p.m. when defendant Cody T. Malone, who was driving in the same direction, struck the rear of his vehicle.

Because of the accident, Sharp was made sick, sore, lame, disordered and disabled; suffered extensive injuries to his head, body, limbs, neck, back and left hip; and incurred medical costs, according to the complaint filed Jan. 7 in Madison County Circuit Court. In addition, he suffered disability, experienced pain and suffering, lost wages and suffered a diminished earning capacity, the suit states.

Malone negligently failed to keep a proper lookout, drove in such a manner that he struck the rear of Sharp's vehicle, failed to properly apply his brakes, drove too fast for the traffic on the road, followed Sharp's car too closely and drove without adequate brakes, the complaint says.

Sharp is seeking a judgment of more than $50,000, plus costs.

He will be represented by John H. Hustava of Collinsville.

Madison County Circuit Court case number: 10-L-15.
