A woman claims she sustained multiple injuries after a driver failed to yield the right-of-way to her.
Debra K. Schultz filed a lawsuit Jan. 5 in Madison County Circuit Court against Jade N. Duhamell and Manheim Gateway Auto Auction.
Schultz claims she drove south on Illinois Route 157 near its intersection with Hollywood Heights Road in St. Clair County on Jan. 17, 2008, at about 11:15 a.m. when Duhamell, who drove west on Hollywood Heights Road, failed to yield the right-of-way and struck Schultz's vehicle. At the time of the accident, Duhamell worked for Manheim Gateway.
Because of the accident, Schultz suffered injuries to her back, neck, head and knees; incurred medical costs; and experienced pain and suffering, the suit states. In addition, she lost wages and suffered disability, the complaint says.
Schultz blames Duhamell for the incident, saying Duhamell negligently failed to maintain control of her vehicle, failed to maintain a proper lookout, failed to yield the right-of-way and drove too fast for the road conditions.
In the two-count suit, Schultz seeks an unspecified judgment, plus costs.
Laura A. Cole of Smith, Mendenhall and Selby in Alton will be representing her.
