Car flipped after being rammed in side, man claims in suit

A man has filed suit against the driver who he says rammed into the side of his car, causing it to flip.

Kenneth E. Dodd claims he was driving his 2005 Dodge Ram truck east on Homer Adams Parkway at its intersection with Alby Street on Oct. 12, 2008, when Rachel M. Braun, who was driving a 2003 Buick Rendezvous south on Alby Street, ran a red traffic signal and struck Dodd's car in the side, causing his truck to flip on its side.

According to the complaint filed Dec. 28 in Madison County Circuit Court, Dodd sustained temporary and permanent injuries and incurred medical costs because of the incident. In addition, he has been prevented from attending to his usual duties, the suit states.

Braun negligently failed to keep a proper lookout, drove too fast, failed to exercise proper control, failed to brake and failed to obey a traffic control device, the complaint says.

Dodd is seeking a judgment of more than $50,000, plus costs.
