Trial scheduled in new year for Wentzville car accident case

Madison County Circuit Judge Andy Matoesian is scheduled to preside over the trial of a negligence case stemming from a 1999 accident near Wentzville, Mo.

Plaintiff Sherri Pate is suing Patricia Dieu for injuries Pate suffered when the car driven by Dieu rolled off the highway near the Missouri town 10 years ago.

Pate claims that Dieu failed to reduce her speed in a construction zone, was unfamiliar with how to drive while pulling a trailer and that she failed to keep a look out.

This is the second time Pate has brought her suit. She first filed in 2000. That first suit was dimissed three years ago without prejudice.

Pate seeks damages of at least $50,000, medical bills and costs.
Dieu denies that she was responsible for the injuries to Pate's neck, lower back and legs.

Matoesian set the case for trial Jan. 4 at 9 a.m.

It had already been continued several times.

Pate is represented by Michael Reid.

Dieu is represented by William Starnes II.

The case is Madison case number 06-L-861.
