Daughter files as administrator over mother's sole asset - future lawsuit

A woman has filed a petition in Madison County Circuit Court requesting that she be appointed special administrator of her deceased mother's estate so that she can file a future lawsuit.

Cynthia A. Wise claims her mother, Laverne Martin, died on Dec. 30, 2007, leaving Wise and Martin's son, Michael W. McMillen, as the only surviving heirs.

"That the sole asset of Laverne Martin's estate is a potential cause of action for wrongful act or neglect pursuant to Para 2.1 of the Wrongful Death Act," the petition filed Dec. 16 in Madison County Circuit Court states.

Wise wants to be appointed special administrator, which will enable her to prosecute the wrongful act claim, the petition says.

She will be represented by TorHoerman Law in Edwardsville.

Madison County Circuit Court case number: 09-L-1360.
