Madison County Circuit Judge David Hylla is slated to hear motions in a six year-old class action over improper fees a mortgage lender allegedly charged.
The case is a remnant of ones that once involved lawyers from the Lakin Law Firm (now LakinChapman) of Wood River and Chicago-based Paul Weiss.
The former allies have sparred a number of times over class actions they filed before severing their ties.
Motions are to be heard at 10:30 a.m. Dec. 22.
Most recently, the LakinChapman firm filed a motion to substitute their new name for their old namesake.
The case was formerly assigned to then-Madison County Circuit Don Weber. Prior to that, the case was assigned to then-Madison County Circuit Judge Phillip Kardis.
The suit seeks damages for improper closing fees Countrywide allegedly charged customers.
Paul Marks represents Morgan and the class.
Beth Bauer represents Countrywide.
The case is Madison case number 03-L-980.
