A scheduled two week legal malpractice trial involving a surgeon/lawyer's case against a law firm that represented him in a medical malpractice trial has settled.
Madison County Circuit Judge David Hylla gave plaintiff Dr. Rocco Marrese and defendant Gundlach, Lee, Eggmann, Boyle & Roessler of Belleville two weeks to file their settlement stipulations.
Marrese's case against the law firm was set to begin Monday morning.
He had sought damages of at least $800,000 and other relief.
Details of the settlement were not yet available in the court file.
Marrese, an orthopedic surgeon and an attorney, sued the Belleville firm for alleged malpractice regarding a $1.8 million verdict against Marrese.
Marrese claimed that the firm made several errors such as allowing him to be called as an adverse witness, failing to employ a rehab specialist and other mistakes.
The 2004 case was originally assigned to then Madison County Circuit Judge Don Weber.
Marrese was represented by Glenn Bradford.
The law firm was represented by Brent Baldwin.
The case is Madison case number 04-L-082.
