A man has filed suit against the driver who he says struck him after failing to obey traffic control signals at a Madison County intersection.
Eric Whitehead claims he was driving north on Maryville Road near its intersection with Clark Drive on Jan. 23 when defendant Michelle Endicott, who was driving east at Clark Drive near the same intersection, failed to observe traffic control signals and struck Whitehead.
Because of the accident, Whitehead suffered severe and personal injuries to his lumbar, cervical and thoracic spine and suffered pain, according to the complaint filed Nov. 25 in Madison County Circuit Court. In addition, he incurred medical costs of $7,488, the suit states.
Endicott negligently failed to keep a proper lookout, violated a stop sign and drove too fast, the complaint says.
Whitehead is seeking a judgment of more than $50,000, plus costs and other relief the court deems just.
