Route 161 accident resulted in injuries, suit claims

A man and his wife have filed suit against the driver who they say rear-ended the man on a Belleville street.

Marvin McIntyre claims he was driving a 2005 Kia Rio north on Frank Scott Parkway at its intersection with Highway Route 161 in Belleville on Nov. 30, 2007, at about 5:30 p.m. when defendant Loretta Friel, who was driving a 1998 Cadillac Deville north behind Marvin McIntyre, rear-ended him.

Because of the accident, Marvin McIntyre has sustained severe and permanent injuries, has been hindered from attending to his usual duties and has incurred medical costs, according to the complaint filed Nov. 25 in St. Clair County Circuit Court.

Donna McIntyre claims she lost her husband's society, conjugal fellowship, companionship, cooperation and aid.

The McIntyres blame Friel for failing to keep a proper distance between her vehicle and the auto in front of her, for failing to decrease her speed to avoid a collision and for failing to keep a proper lookout.

In the three-count suit, the McIntyres are seeking an unspecified judgment, plus costs.
