Freeburg rear-end accident is subject of suit

A man has filed suit against the driver who he says struck the back of his vehicle.

Chad E. Kempfer claims he was driving north on South State Street at its intersection with East Emily Street in Freeburg on Oct. 10 when defendant Terri D. Repp, who was also driving north on South State Street, struck the rear of his vehicle. In turn, Kempfer rear-ended the driver in front of him.

Because of the collision, Kempfer was made sick, sore, lame, disordered and disabled; received injuries to his neck, arms and back; and incurred medical costs, according to the complaint filed Nov. 16 in St. Clair County Circuit Court. In addition, he suffered disability, experienced pain and suffering and lost money from the loss of wages, the suit states.

Repp negligently failed to keep a proper lookout, drove in such a manner that she struck the rear of Repp's vehicle, failed to apply her brakes, drove too fast and drove too closely to Kempfer's vehicle.

Kempfer is seeking a judgment of more than $50,000, plus costs.

He will be represented by Thomas C. Rich and Jennifer L. Barbieri of Fairview Heights.

St. Clair County Circuit Court case number: 09-L-619.
