Driver strikes parked semi, sues leasing company

An East St. Louis man has filed suit against Parrish Leasing Company and Affton Fabricating and Welding Company, blaming them for causing him to hit a semi parked in the middle of a road.

In the lawsuit he filed Nov. 2 in St. Clair County Circuit Court, DeMarco Nicholson claims he was driving on Sauget Industrial Parkway on June 29, 2008, when he struck a semi-trailer parked in the middle of the road owned by Parrish Leasing Company.

Because of the collision, Nicholson was made sick, sore, lame, disordered and disabled, suffered a fracture to his skull and injuries to his body and incurred medical costs, according to the complaint. In addition, he suffered disability, experienced pain and suffering and lost wages, the suit states.

Nicholson blames Parrish for illegally parking the semi-trailer in the middle of the road and for failing to warn him of the semi-trailer.

Affton allowed Parrish to park its truck in the middle of the road, the complaint says.

In the two-count suit, Nicholson is seeking a judgment of more than $100,000, plus costs.

Van-Lear P. Eckert of Williams, Caponi, Foley and Eckert will be representing him.
