Parties agree to move trial in Bethalto dog bite suit

The parties in a case over a dog bite at a home in Bethalto have agreed to move their Nov. 2 trial.

The parties entered the motion Oct. 23, agreeing to amend their case management order and postpone their date with a jury.

The plaintiff in the case, James Luebbert, contends that he did not provoke the dog that bit him and seeks unspecified damages. The defendant, Jerret Scott, admits his dog bit Luebbert but denies that the attack was unprovoked.

The attack occurred in June 2007. Luebbert claims the dog injured his lower right leg, caused him to incur medical expenses, lose wages and to suffer pain and disability.

Madison County Circuit Judge Daniel Stack is presiding.

Luebbert is represented by Steve Selby and Laura Cole of Alton.

Scott is represented by David Hesi.

The case is Madison case number 08-L-474.
