The plaintiff in a Granite City car accident suit is asking Madison County Circuit Judge Daniel Stack to find that the defendant was liable for hitting him.
Plaintiff Rudolph Muzzarelli filed a move for summary judgment Oct. 26 on the liability issue in his suit and a request for a continuance of the trial set Nov. 2.
Muzzarelli is suing Matthew Evans for allegedly hitting his car and injuring him in April 2006.
He seeks damages of at least $50,000 and his medical expenses.
The case is currently scheduled for trial Monday at 9 a.m.
According to his complaint, Evans struck Muzzarelli's car as he waited to make a left turn from Madison Street in Granite City onto 26th Street.
Muzzarelli contends that Evans was negligent in failing to yield, failing to drive safely and following Muzzarelli's 1998 Plymouth Voyager too closely.
Muzzarelli claims he suffered neck, back and leg injuries in the crash.
The plaintiff is represented by Rich Verticchio of Gillespie.
Evans is represented by Thomas Zimmer.
