A man has filed suit against the driver who he says struck him after failing to yield at a stop sign.
Harold R. Lawary claims he was driving north on 47th Street near its intersection with Summit Avenue in East St. Louis on Nov. 10, 2008, at about 5:30 p.m.
At the same time, defendant James E. Andrews was driving east on Summit Avenue near the same intersection, according to the complaint filed Oct. 19 in St. Clair County Circuit Court.
"At the aforementioned intersection, Defendant had a stop sign and Plaintiff did not," the suit states. "At the aforesaid date, time and place, the vehicles being operated by both parties entered the intersection and collided."
As a result, Lawary was forced to seek medical treatment, incurred costs for the treatment and lost his income and his ability to work, the complaint says.
Lawary blames Andrews for striking his vehicle, for violating a stop sign, for failing to keep a proper lookout and for failing to yield the right-of-way.
Lawary is seeking a judgment of more than $50,000, plus costs and other relief the court deems just.
Christopher K. Geldmacher of Sauter and Sullivan in St. Louis will be representing him.
St. Clair County Circuit Court case number: 09-L-559.
