A man who says he was attacked by an intoxicated man at a bar has filed suit against the establishment.
Chad Moss claims he was at DJR Properties doing business as Broadway Bar and Grill in Trenton on May 1 when Brendan Delaney, who had consumed alcoholic beverages at the establishment, attacked him without provocation.
Because of the attack, Moss sustained severe and permanent injury, incurred medical costs, lost large sums of money he otherwise would have gained under his normal employment, experienced a damaged earning capacity and incurred disability, disfigurement, pain and suffering, according to the complaint filed Oct. 19 in Madison County Circuit Court.
Broadway Bar and Grill negligently failed to timely contact the police to assist Moss when the fight broke out, failed to intervene in the attack, failed to train its employees to stop the attack, failed to protect Moss from the misconduct of Delaney, failed to properly manage the premises, failed to provide appropriate personnel to protect against the misconduct of its patrons and failed to properly protect its patrons, among other negligent acts, the suit states.
In the two-count suit, Moss is seeking a judgment of more than $100,000, plus costs and other relief the court deems just.
