Crowder asked to give go-ahead to wrongful death suit settlement

Madison County Circuit Judge Barbara Crowder will hear arguments for the initial approval of a settlement between the parents of a man killed in 2008 and the company and driver of the truck they allege caused his death.

The hearing is set for 9 a.m. on Oct. 23.

Plaintiffs Patrick and Linda McMahon are suing Odesco Industrial Services and its employee, Matthew Yon. Their suit, brought under Missouri's wrongful death laws, sought unspecified damages.

Odesco and Yon are from Madison County.

The McMahons claim that Yon, while driving a truck for his employer, rear ended the car their son, Michael McMahon, was a passenger in on Feb. 9, 2008. That car was stopped at an intersection along Telegraph Road in St. Louis County. Michael McMahon died in the collision.

His parents allege Yon and Odesco were responsible for the death because Yon drove at an excessive speed, failed to keep lookout and the truck followed the car too closely.

The notice of the settlement hearing was filed by the plaintiffs Oct. 14.

The McMahons are represented by Troy Walton of East St. Louis and Gary Growe of St. Louis.

The defendants are represented by Lawrence Grebel of St. Louis.

The case is Madison case number 08-L-689.
