The driver of a vehicle and his passenger have filed suit against the driver who they say rear-ended the vehicle in which they were riding.
Michael and Michelle Miller filed a lawsuit Oct. 2 in Madison County Circuit Court against Mark A. Overmeyer.
Michael Miller claims he was driving a 1999 Jeep Cherokee on River Road Route 100 at its intersection with Clifton Terrace on Oct. 6, 2007, when Overmeyer, who was driving behind him, struck him from behind. At the time of the collision, Michelle Miller was riding as a passenger in Michael Miller's vehicle.
Because of the collision, Michael Miller sustained severe and permanent injuries to his back, neck and left shoulder while Michelle Miller injured her back, neck and shoulders, according to the complaint.
Both Millers incurred medical expenses of more than $50,000 each and lost wages of more than $50,000 each, the suit states.
Overmeyer negligently drove too fast, failed to stop or swerve to avoid a collision, failed to keep a careful lookout and allowed his vehicle to collide with Miller's, the complaint says.
The Millers are seeking a judgment of more than $50,000, plus costs.
