Couple sues driver over rear-end accident

A couple has filed suit against the driver who they claim rear-ended their vehicle.

Harry F. Montane claims he was driving a 2005 Chevrolet Silverado north on Illinois Route 3 approaching its intersection with Northgate Industrial Drive on Sept. 27, 2007. Riding as his passenger was plaintiff Ruby E. Montane.

Suddenly, defendant Dawn Coolbaugh-Martin, who was driving a 2003 Chevrolet Impala north on Illinois Route 3, struck the rear of the Montanes' vehicle, according to the complaint filed Sept. 25 in Madison County Circuit Court.

Because of the accident, the Montanes suffered severe and permanent injuries and extreme pain, incurred substantial sums of money to be cured of his injuries, were disabled and lost their enjoyment of life, the suit states.

They blame Coolbaugh-Martin for failing to keep the vehicle under control, for failing to keep a proper lookout and for failing to reduce her speed.

In the two-count suit, the Montanes are seeking a judgment of more than $100,000.

They will be represented by John T. Papa of Callis, Papa, Hale, Szewczyk and Danzinger of Granite City.
