St. Clair County Circuit Judge Michael O'Malley has given the plaintiff in a suit over the burial of a man under the wrong name more time to find a new attorney.
Plaintiff Kathleen Beecher-Miller has 45 more days to find new counsel according to a Sept. 30 order signed by O'Malley. Her previous attorney, Gary Mack, withdrew from the case.
Beecher-Miller is suing the City of East St. Louis and Detective Michael Floore for allegedly failing to follow procedure to properly identify her son's body. The body was released to the wrong family, buried under the wrong name and subsequently exhumed for proper reburial.
Beecher-Miller's son, Kenny Thomas Stainbeck, was murdered.
Beecher-Miller is suing for the emotional distress she claims to have suffered due to the mistake.
She seeks damages in excess of $100,000 and costs.
Mack withdrew from the case Aug. 26.
The defendants have moved to dismiss the suit.
The defendants are represented by Untress Quinn.
A status conference is set for December in the suit.
The case is St. Clair case number 09-L-081.
