A Belleville resident claims a driver struck him after he exited a car.
Sukura W. Spiller filed a lawsuit Sept. 23 in St. Clair County Circuit Court against Armond C. Wilbourn Sr.
Spiller claims he was a passenger in a 1997 Ford Taurus, which was stopped on the side of Paulette Drive facing south near its intersection with Kensington Heights Road in Belleville, when he exited the car and began walking east on Paulette Drive on Dec. 22.
At the same time, Wilbourn was driving a 2004 Pontiac Grand Prix north on Paulette Drive when he hit Spiller, according to the complaint.
Because of the accident, Spiller was hindered from participating in his normal activities, lost wages, suffered mental and physical anguish and incurred medical costs, the suit states.
Spiller blames Wilbourn for failing to sound his horn, for driving too fast, for failing to keep his vehicle under adequate control and for failing to keep a proper lookout.
Spiller is seeking a judgment of more than $50,000, plus costs.
Mark C. Scoggins, Clay B. St. Clair and Anthony P. Gilbreth of Crowder and Scoggins in Columbia will be representing him.
St. Clair County Circuit Court case number: 09-L-502.
