A concrete company employee claims his nervous system was damaged after the chute to a truck struck him in his head and chest.
Kenneth Buneta filed a lawsuit Aug. 19 in Madison County Circuit Court against RC Lonestar, Inc. and Red-E Mix.
Buneta was working for Rakers Concrete on Aug. 23, 2007, and was helping to pour a patio pad in Highland when the incident occurred.
"The Plaintiff was injured when the operator of the truck drove forward without warning to the Plaintiff causing the chute to sway and struck the Plaintiff in the head and chest," the suit states.
Because of the incident, Buneta says he sustained permanent injury, lost wages and incurred medical bills, in addition to his nervous system injury.
Buneta blames RC Lonestar and Red-E Mix for moving the truck at a time when the chute was not secured, for failing to warn workers around the truck that the truck was about to move and for failing to keep a proper lookout for workers around the truck.
In the two-count suit, Buneta is seeking a judgment of more than $100,000.
