Beer bottle bop injures bar patron, suit claims

A woman is blaming the owner of a bar for injuries she sustained after a patron at the drinking establishment allegedly became intoxicated and hit her over the head with a bottle.

Kimberly Kudelka filed a lawsuit Aug. 12 in Madison County Circuit Court against Larry Wofford, doing business as Luna Cafe.

Kudelka claims she was at Luna Cafe on Aug. 26, 2008, when Brandy Keck, who allegedly was intoxicated from alcohol she was served at the bar, hit Kudelka over the head with a beer bottle.

Because of the incident, Kudelka says she sustained severe and permanent injuries, was hindered from attending to her usual duties, lost wages and her earning capacity and suffered mental and physical anguish, according to the complaint. Kudelka also claims she incurred medical costs.

Kudelka is seeking a judgment of more than $50,000, plus costs the court deems just.

Gregory M. Tobin of Pratt and Tobin in East Alton will representing her.

Madison County Circuit Court case number: 09-L-839.
