I-55 accident is subject of suit

A woman has filed suit against the driver who she says forced her off the road after he rear-ended her.

Debra Nichols claims she was driving north on Interstate 55/Interstate 70 near mile post 11 when the front of Dale F. Geiger's vehicle collided with the rear of her vehicle, propelling Nichols's vehicle into the right shoulder where she struck a guard rail end post and came to rest in the right side ditch.

Because of the accident, Nichols suffered injuries to her head, neck, back, left elbow, trunk, spinal column, vertebrae and intervertebral discs, according to the complaint filed Aug. 11 in Madison County Circuit Court. She also suffered from bilateral arm numbness, headaches and damage to her entire nervous system, causing her physical pain and mental anguish, the suit states. Nichols incurred medical costs and suffered an impaired function of her body parts, the complaint says.

Geiger negligently drove too fast, failed to keep a proper lookout ahead and laterally, failed to stop or swerve to avoid a collision and failed to give any warning of his imminent approach, Nichols claims.

Nichols is seeking a judgment of more than $50,000, plus costs.
