Worker claims he was discharged after filing for workers' comp

A man has filed suit against his former employer, alleging he was illegally fired after applying for his workers' compensation benefits.

Jeffery D. White claims he began working for Yellow Transportation Inc, doing business as Yellow Freight, in August 1993.

On Feb. 6, 2008, White was injured while working for Yellow Freight and was fired on Aug. 11, 2008, because he applied for workers' compensation insurance, according to the complaint filed July 29 in Madison County Circuit Court.

Because of his discharge, White has lost wages, benefits, raises and promotions, incurred costs associated with securing subsequent employment and suffered humiliation and mental distress, the suit states.

White is seeking a judgment of more than $50,000, plus costs and other relief the court deems just.
