Homeowners sue Fox Ridge Lake association

A Godfrey couple has filed suit against Fox Ridge Lake Homeowners Association and four of its officers, alleging the association and its officers forged a piece of land that was supposed to belong to the couple.

Charles and Sherri Creekmore, who live at 1301 Beanehaven Dr., claim they are dues paying members of Fox Ridge Lake Homeowners Association.

According to the complaint filed July 24 in Madison County Circuit Court, the Creekmores discovered a forged plat after their land was not admitted into evidence in a trial involving them in September.

"The defendant, Fox Ridge Lake Homeowners Association, has allowed a plat purported to be forged to be recorded herein thus causing a cloud on the Plaintiff's title, that of which was discovered by the Plaintiffs in September of 2008," the suit states.

Also included as defendants in the suit are Jim Beane, an officer of the Fox Ridge Lake Homeowners Association; Elizabeth Beane, who has management authority with the association; Eugene Bollefer, president officer; and Wayne Kiel, treasurer.

In addition to their complaint about the land, the Creekmores claim Jim Beane has discriminated against them as he strictly enforces rules on the couple, but not on others who live in the subdivision.

"The Defendant, Jim Beane, has engaged in a pattern of harassing behavior against the plaintiffs herein," the suit states.

In the seven-count suit, the Creekmores are asking the court to order the original plat to be the proper plat, plus attorneys' fees, costs and other relief the court deems just. They are also asking for a judgment in excess of $300,000.

They are represented by Jeffrey C. Weishaupt in East Alton.
