Non-jury trial set in case of unpaid for food services

A non-jury trial is scheduled for July 29 in Madison County Circuit Court in a suit brought by food service providers who claim their clients didn't pay them after they got the food.

Plaintiffs Robert's Sysco Food Services Inc. and Sysco Food Services of St. Louis LLC are suing six defendants whom they claim breached their contracts for food services.

Circuit Judge David Hylla is presiding over the case. The court docket indicates that the trial will begin at 9 a.m.

The defendants in the suit are A.R.C. of Jacksonville, Ill., Skyview Terrace Ltd., Springfield Terrace Ltd., Vandalia Terrace Ltd., Litchfield Terrace Ltd. and Melvin Siegel, the guarantor of the other defendants' lines of credit.

According to the plaintiffs' amended complaint, the six ordered food and services from them but did not pay for it after it was delivered. The suit also alleges that the defendants' assets will be sold Aug. 20.

The plaintiffs are seeking the following amounts plus one and one half percent interest per month, costs and attorneys' fees:

  • $18,279.28 from A.R.C. of Jacksonville, Ill.

  • $25,367.47 from Skyview Terrace

  • $18,882.68 from Springfield Terrace

  • $21,142.05 from Litchfield Terrace

  • $11,100.69 from Vandalia Terrace

  • $62,529.43 and $32,242.74 from Siegel.

    The case had originally been assigned to Madison County Circuit Judge Barbara Crowder. She recused herself.

    The plaintiffs are represented by Lawrence Taliana of Edwardsville.

    The defendants are represented by Jason Johnson of Edwardsville.

    The case is Madison case number 08-L-743.
