Accident caused $25k worth of medical treatment, suit claims

A woman blames a Belleville man for causing her to allegedly incur more than $25,000 in medical costs and lost wages after a collision.

Jeanette Riley filed a lawsuit July 13 in St. Clair County Circuit Court against Olyn L. Hudspeth Jr.

Riley claims she was driving west on East A Street near its intersection with North Charles Street on Sept. 17, 2007, when Hudspeth, who was driving north on North Charles Street, collided with her.

"Defendant saw or by the use of ordinary care could have seen the vehicle operated by Plaintiff was located in a position of imminent peril of being struck and that Defendant had ample time to have stopped his motor vehicle, turned or swerved it, slacken the speed of, or given a warning of its approach, in time thereafter to have thereby avoided striking the vehicle operated by Plaintiff but that Defendant failed and omitted to do so," the complaint says.

Because of the collision, Riley's back, spine and right hip were injured; she suffered a herniated disc in between her fourth and fifth lumbar vertebra; and all of her injuries are serious, permanent and progressive, the suit states. In addition, Riley suffered pain of the body, anguish of the mind and a diminished function of her body parts, incurred medical and other related expenses of $16,500, experienced an impaired ability to enjoy her every day activities and to work and lost wages of at least $9,000, according to the complaint.

She blames Hudspeth for performing a number of negligent acts, including failing to decrease his speed, failing to keep his vehicle under proper control, failing to see her vehicle, failing to yield the right-of-way at an intersection, pulling into her lane of travel when it was not safe to do so, failing to stop to avoid a collision and failing to apply his brakes in time to avoid an accident.

Riley is seeking a judgment of more than $50,000, plus costs.
