Wal-Mart sued by customer claiming injuries in slip on water

A St. Clair County woman has filed suit against Wal-Mart and one of its managers, alleging she fell on water that had leaked from a cooler.

Marsha M. Dickson says she was shopping at the O'Fallon Wal-Mart on Aug. 26, 2007, when she injured her hip after falling on the water.

Because of the injuries she sustained in her fall, Dickson says she has been prevented from attending to her usual affairs and incurred substantial medical costs. She also suffered great pain and lost wages, according to the complaint filed April 28 in St. Clair County Circuit Court.

Wal-Mart was negligent by allowing a cooler to leak water onto the floor, by failing to mop up the water and by failing to warn patrons of the water, the suit states.

Store manager David W. Roper negligently failed to implement proper safety precautions for the remediation of a slippery surface on which patrons were walking, Dickson claims.

In the two-count suit, Dickson is seeking a judgment in excess of $100,000, plus costs.

She will be represented by Bernard J. Ysursa of Cook, Ysursa, Bartholomew, Brauer and Shevlin in Belleville.
