A St. Clair County woman is suing Wal-Mart over an alleged injured right wrist and right arm she says she sustained after she slipped on ice in the store's parking lot.
Belinda K. Fitz says she was at the O'Fallon Wal-Mart on Dec. 19, 2007, when she slipped and fell on the parking lot.
In addition to her injuries, Fitz experienced severe pain and suffering, incurred medical expenses, lost wages and has sustained an impaired ability to work, labor and enjoy life, according to the complaint filed April 24 in St. Clair County Circuit Court.
Wal-Mart negligently allowed the unnatural accumulation of ice, allowed the ice to remain on the parking lot and failed to remove the ice, the suit states.
Fitz is seeking a judgment in excess of $50,000, plus costs.
Brian S. McChesney and Craig M. Ortwerth of McChesney and Ortwerth in St. Louis will be representing her.
St. Clair County Circuit Court case number: 09-L-213.
