Woman claims doctors failed to diagnose husband's cancer

The wife of a recently deceased man is suing three doctors, alleging they did not diagnose her husband's cancer at the appropriate time.

Donna K. Shevlin filed a lawsuit April 20 in St. Clair County Circuit Court against Drs. Paul Malcharek, Mayank Patel and Ann Hagedorn.

Donna Shevlin says Richard L. Shevlin was admitted to Memorial Hospital in Belleville for treatment on Sept. 8, 2006.

However, Malcharek, Patel and Hagedorn failed to diagnose cancer that was evident on diagnostic studies they performed and failed to consult a pulmonologist to aid in their diagnosis and medical management, the complaint filed April 20 in St. Clair County Circuit Court says.

The doctors also allegedly failed to inform Richard L. Shevlin of the diagnosis of his lung condition, failed to follow up with him after his release from the hospital and failed to tell him of the need for further follow-up diagnostic testing.

As a result of the doctors' alleged negligence, Richard L. Shevlin was not diagnosed with metastatic cancer until April 20, 2007, according to the complaint.

He died from the disease on April 28, 2007, the suit states.

In her complaint, Donna Shevlin included Memorial Hospital and doctors Babak Rejaie, Robert Maxey, Alvin Webster and Kathleen Fournier as respondents in discovery, allowing her a six-month time frame to include them as defendants, also.

In the 11-count suit, Donna Shevlin is seeking a judgment in excess of $300,000, plus costs.

Terry N. Brown of Brown and Associates in Belleville will be representing her.

Madison County Circuit Court case number: 09-L-203.
