Insurance company sues contractor over electrical fire

An insurance company is suing an electrical company and its owner over shoddy wiring work that it says led to a fire at its client's home.

Amco Insurance Company, as subrogee of Betty J. Stogner, filed suit April 20 in St. Clair County Circuit Court against R & R Exteriors and Erick Kattenbraker.

Amco says Stogner hired R & R Exteriors to complete electrical repairs at her residence, 106 Hazel Ave. in Belleville.

Kattenbraker performed the repairs and ran a new wire and conduit from the electrical pole to the residence mast and to the residence service panel, the complaint says.

After Kattenbraker completed the work, a June 19, 2007, fire caused $199,176.86 worth of damage to Stongner's home. The fire originated in the main circuit breaker panel, according to the suit.

Stogner submitted a claim to Amco and it paid her for the property damage she incurred, according to court records.

Amco says Kattenbraker is guilty of negligence. Because Kattenbraker is an employee and owner of R & R Exteriors, the company is liable for damages, also, the suit states.

In addition to the money it paid Stogner, Amco is seeking costs and other relief the court deems just.

Stuart M. Brody of Sneckenberg, Thompson and Brody in Chicago will be representing it.

St. Clair County Circuit Court case number: 09-L-201.
