Man attacked at Collinsville bar seeks $1 million-plus

A man and his wife are seeking more than $1 million in a suit they filed against a Collinsville bar, its owners and two bar patrons.

Marvin and Gina Allen claim Marvin Allen was visiting Teezer's on June 26 when he was seriously injured after two patrons attacked him.

The two men, Daniel and Dennis Pereira, were at the bar and became intoxicated, according to the complaint filed April 6 in St. Clair County Circuit Court.

Because of the Pereiras' intoxicated state, they attacked, assaulted and battered Marvin Allen, the suit states.

"There was a chain of casual connection between the intoxication the injuries to Marvin Allen," the suit states.

Because of the attack, Marvin Allen says he sustained serious injuries to his head, left ankle and right hand and lost his smell, taste and hearing. He also now suffers from tinnitus, dizziness and headaches, has been unable to participate in his ordinary affairs, experienced great pain and suffering and incurred substantial medical costs.

He lost wages, suffers from a disability, lost his normal life and has become permanently disfigured, according to the complaint.

Marvin Allen's wife, Gina, says she will incur medical bills, has suffered the loss of her husband's services and has suffered the loss of his consortium, including his society, companionship and sexual relations.

Teezers and owners Tisa Winfree and Joey Grzywacz should have provided safety for Marvin Allen, the suit states.

In addition, because they knew of the Pereiras' violent propensities, Winfree, Grzywacz and Teezers should not have allowed the Pereiras on the premises and should have warned customers about them, Marvin Allen alleges.

In the 24-count suit, the Allens are seeking a judgment in excess of $1.2 million, plus other relief the court deems just.

They are represented by Mary M. Stewart of Brunton Law Offices in Collinsville.

St. Clair County Circuit Court case number: 09-L-175.
