Diggers Dugout responsible for patron's knock-down, suit claims

A Worden bar is being sued by a woman over injuries the woman sustained after she says two other women beat her at the bar.

Lindy Castleman filed suit against Diggers Dugout Tavern and owner Tracey Gregg on March 27 in Madison County Circuit Court, claiming her left wrist, cheek bone and nose were fractured after the fight.

Castleman says she was at the bar on April 1, 2008, when Tiffany and Kacy Hammock beat her and knocked her to the ground while hitting and assaulting her.

The complaint says that in addition to her fractures, Castleman received a broken right wrist and will be prevented from attending to her usual duties and affairs because of the fight. She also claims she has lost the value of time, suffered great pain and anguish and incurred substantial medical costs.

Since Diggers Dugout Tavern sold intoxicating beverages to the Hammocks, it is liable through the Dram Shop Act, the complaint says.

Castleman is seeking an unspecified judgment, plus costs and other relief the court deems just.
