McCoys claim emotional distress after shots fired in their direction

Two men claim they suffered severe emotional distress after a man shot in the direction of their vehicle several times.

Kevin and Chad McCoy say they were in their vehicles at Bethalto Boulevard and Texas Boulevard in Bethalto on on Sept. 24, 2007, when James L. Ferando discharged a firearm multiple times in their direction.

"The aforesaid willful and wanton and reckless conduct of the Defendant proximately caused Plaintiff Kevin McCoy to incur, and he may in the future incur, severe emotional distress, substantial expenses in efforts to cure himself of his injuries, and loss of his normal life," the suit filed March 25 in Madison County Circuit Court states.

Chad McCoy was also affected in the same way, the McCoys' lawyer, Jospeh R. Brown Jr. of Lucco, Brown, Threlkeld and Dawson in Edwardsville, wrote in their complaint.

In the four-count suit, the McCoys are seeking a judgment in excess of $60,000, plus costs.

Madison County Circuit Court case number: 09-L-306.
