Fairview Heights accident is subject of suit

A St. Clair County woman has filed suit against a St. Clair County man, alleging she received head and neck injuries after he collided with her.

Toni Blair was turning into the westbound lane of Lincoln Highway from the St. Clair Square parking lot across from Frey Lane in Fairview Heights on March 26, 2007, when Johnnie Foster, who was driving west on Lincoln Highway, collided with her, according to the complaint filed March 25 in St. Clair County Circuit Court.

In addition to her injuries, Blair was hindered from attending to her normal duties and affairs, lost large sums of money that would have accrued to her and experienced great physical and mental pain, suffering and anguish, the suit states. She also claims she will incur substantial medical costs.

Foster was negligent by failing to keep a proper lookout, by failing to observe Blair, by failing to keep his vehicle under control, by failing to apply his brakes, by failing to decrease his speed to avoid a collision, by failing to turn to avoid hitting Blair, by failing to give proper warning and by driving too close to Blair, according to the complaint.

Blair is seeking a judgment in excess of $50,000, plus costs.
