Collision on I-270 is subject of suit

A man has filed suit over an I-270 auto accident.

Kris O. Rowe was driving his 2003 Mitsubishi Montero east on I-270 about 800 feet west of mile post two in Madison when Albin C. Rak III, who was driving a 2004 Chevrolet Silverado east on I-270, rear-ended Rowe, according to the complaint filed March 18 in Madison County Circuit Court.

Because of the collision, Rowe was injured both internally and externally, suffered great physical pain and mental anguish and will be hindered from attending to his usual duties, the suit states.

He also incurred medical expenses, he claims.

Rak was negligent by failing to keep his vehicle under proper control, by driving too fast for the traffic conditions, by failing to keep a lookout and by failing to apply his brakes to avoid a collision, according to the complaint.

Rowe is seeking a judgment in excess of $50,000, plus costs.

He is represented by Philip R. Rice of Rice Law Offices in Belleville.

Madison County Circuit Court case number: 09-L-0269.
