A woman claims her daughter was injured after the vehicle in which she was a passenger "violently" collided with another vehicle.
On March 17, Cynthia E. Founie filed suit individually and on behalf of her minor daughter, Madilyn R. Founie, against Ashley R. Hughes in St. Clair County Circuit Court.
They say Hughes was driving her 1996 Ford Escort north on Dutch Hollow Road at its intersection with Highway 161 in Belleville. Madilyn R. Founie was riding with Hughes.
At the same time, Rose S. Wiley was driving a 1996 Dodge Caravan east on Highway 161 at the same intersection, the complaint says.
"At said time and place, the vehicle driven by Defendant collided violently with the vehicle being driven by Rose S. Wiley," the suit states.
Because of the accident, Madilyn R. Founie suffered head, shoulder, back and hand injuries and experienced great pain and mental anguish, Cynthia E. Founie alleges.
Both Madilyn R. Founie and Cynthia E. Founie incurred substantial medical costs, according to the complaint.
Hughes was negligent by driving too fast for the circumstances, by failing to keep a proper lookout, by failing to give an audible warning of her approach, by failing to reduce her speed, by failing to keep her vehicle under proper control, by driving too fast to stop within the range of her vision and by driving without working brakes, the suit states.
Cynthia E. Founie alleges Hughes also negligently failed to obey the stop sign and failed to yield the right-of-way.
In the two-count suit, Cynthia E. Founie is seeking a judgment in excess of $100,000, plus costs.
