A man says he was seriously injured after he fell on liquid at a Granite City McDonald's.
James D. Murphy III on March 17 filed suit in Madison County Circuit Court against Estel Foods, the owner of McDonald's, and McDonald's Corporation.
Murphy claims he was walking toward the restroom at the McDonald's located at 2045 Madison Avenue on April 3, 2007, when he slipped and fell on a liquid near the bathrooms.
"Plaintiff did not misuse the premises in any way," the complaint states.
Because of his fall, Murphy claims he suffered injuries to his shoulders, neck and back, suffered great physical pain and anguish and incurred medical expenses.
He has also been unable to perform his usual activities, endured disability and loss of a normal life and has suffered disfigurement, the complaint says.
Estel and McDonald's failed to place proper caution signs, failed to follow their own rules and regulations regarding placing proper caution signs and failed to keep their property in a safe condition, according to the suit.
In the two-count suit, Murphy is seeking a judgment in excess of $100,000, plus costs.
