Lawyers for The Cedars at the JCA in Chesterfield, Mo. have removed a personal injury lawsuit to U.S. District Court for the Southern District of Illinois.
Ellanora Zysk sued The Cedars on Jan. 26 in St. Clair County Circuit Court. She claims that while she was a passenger on a bus owned by The Cedars, she was injured while on the way back to her home in Fairview Heights.
The notice of removal was filed Tuesday, Feb. 10.
James A. Wilke of the Wilke and Wilke Law Firm in St. Louis represents the Cedars.
According to the removal petition, the request was made based upon "the existence of diversity of citizenship between Plaintiff and Defendant pursuant to the diversity jurisdiction of this court (St. Clair County) and 28 U.S.C. Section 1332 (a)(1)."
The suit alleges that the driver of the bus failed to drive at a speed which was reasonable and proper in light of the conditions, failed to adequately secure the plaintiff in her wheelchair, failed to drive at a speed which was reasonable and proper in light of the load in her vehicle and drove at a speed which was too fast for the condition of the roadway.
Zysk is seeking in excess of $50,000. She is represented by Gregory Shevlin, from Cook, Ysursa, Bartholomew, Brauer, and Shevlin in Belleville.
