A man is suing a woman over a collision in Madison County in which the woman allegedly drove into the path of the man's motorcycle.

Kirby Baker claims he was driving a 2002 Harley Davidson south on Humbert Road near its intersection with North Alby on March 10, 2007.

At the same time, Marsha Hartman was driving her 1996 Pontiac Grand Am out of a driveway at Woodbury Manor when she crashed into Baker, according to the complaint filed March 9 in Madison County Circuit Court.

Due to the collision, Baker will be hindered from attending to his usual affairs, has lost value of his time and has suffered great physical and mental pain and anguish, his lawyer, Steve Selby of Smith, Mendenhall and Selby in Alton, wrote in the complaint.

Hartman was at fault because she drove too fast, failed to keep her vehicle under control, failed to keep a proper lookout, failed to apply the brakes on her vehicle, failed to stop when danger was imminent and failed to yield the right-of-way, the suit states.

Baker is seeking a judgment in excess of $50,000, plus costs.
