A man has filed suit against a St. Anne man and the company for which he was working after he was injured in a collision.
Richard Wolff claims he was driving west on Interstate 44 near its intersection with Viaduct Street in Franklin County, Mo., on July 2, 2007, when Ambers Leon Fisher, who was driving a tractor-trailer in the same direction, struck Wolff's vehicle and forced it into a bridge wall.
At the time of the accident, Fisher was working for M & D Freight, Inc., according to the complaint filed March 9 in St. Clair County Circuit Court.
Because of the collision, Wolff sustained injuries to his neck, back and leg, endured severe pain and suffering and incurred medical costs in excess of $26,000, according to the complaint.
Wolff also lost his ability to enjoy and pursue the normal pursuits of life, the suit states.
Wolff claims Fisher was negligent by driving at an unreasonably high rate of speed, by failing to keep a careful lookout, by failing to keep the vehicle under control, by driving with inadequate brakes, by driving with improper window tinting on the driver's and passenger's side windows and by driving the front end of the vehicle into Wolff's vehicle.
M & D Freight was negligent through its employee, according to the complaint.
In the two-count suit, Wolff I seeking a judgment in excess of $100,000, plus costs and other relief the court deems just.
He is represented by Joseph R. Dulle of Stone, Leyton and Gershman in St. Louis.
