State Farm sues to recover insured's damages

State Farm Mutual Automobile Insurance has filed suit against Mark Adams, alleging the company was forced to pay more than $50,000 to one of its insured clients after the client and Adams collided.

On Jan. 20, 2007, State Farm's insured client, Terrence Diebold, was driving a trailer carrying a Mustang aboard on Lebanon Street in Collinsville when Adams, who failed to stop at a stop sign, collided with Diebold, according to the complaint filed Jan. 22 in Madison County Circuit Court.

Because of the accident, Diebold's Mustang was severely damaged and Diebold suffered injuries and experienced great pain, anguish and suffering, the suit states.

Diebold also lost income and incurred medical expenses, State Farm alleges.

Because it insured him, State Farm paid Diebold $59,228.99 for his damages, according to the complaint.

Adams was negligent by failing to keep a proper lookout, by driving too fast, by failing to apply his brakes to avoid a collision and by disregarding traffic signals and signs, the suit states.

He will be represented by Sharon S. Costa of the Costa Law Office in Mt. Vernon.
