Collision on Route 40 leads to suit

Laura A. Deason and Bradley L. Bequette have filed suit against Aaron F. Holderman, alleging they were injured after a collision.

Deason was riding in a vehicle Bequette was driving north on Hemlock at its intersection with United States Route 40 in Highland on Nov. 3, according to the complaint filed Jan. 6 in Madison County Circuit Court.

They were stopped at a stop sign when Holderman, who was driving in a vehicle behind them, failed to stop in time and rear-ended them, the suit states.

Because of the accident, Deason suffered injuries to various parts of her body, plus pain, permanent disability and disfigurement, she claims.

Bequette sustained injuries to various parts of his body, from which he will suffer pain and permanent disability and incurred medical expenses, according to the complaint.

Holderman was negligent by driving too closely to the rear of the Bequette's vehicle, by failing to stop for a stop sign, by failing to keep a proper lookout and by failing to stop, slow down or swerve to avoid a collision, according to the complaint.

In the two-count suit, Deason and Bequette are seeking a judgment in excess of $100,000, plus costs.

Brad L. Badgley of Belleville will be representing them.

Madison County Circuit Court case number: 08-L-0005.
