Brandon McCrary has filed suit against Steven Barton and his father, Matthew Barton, after allegedly being hit in the eye.
While at 4200 Humbert Road in Alton on Oct. 30, McCrary, who was 17 at the time, claims 17-year-old Steven Barton struck him in the eye area, according to the complaint filed Jan. 6 in Madison County Circuit Court.
Because of the incident, McCrary claims he suffered injuries to his eye, experienced pain, suffering and disability and incurred medical expenses.
Matthew Barton breached his duty to control and supervise the conduct of his son, which resulted in McCrary's injuries, the suit states.
In the four-count suit, McCrary is seeking a judgment in excess of $150,000 and another judgment against Matthew Barton for actual damages to the maximum extent provided under the Illinois Parental Responsibility Law.
